The postulated „Zeitenwende“ should not be understood simply as a historic opportunity to quickly pass the proposed reform in parliament. Even beyond the specific occasion of the Russian attack on Ukraine, the substance of the constitutional provisions on defence appears to be in need of reform. Ein verfassungsrechtliches Fundament für Auslandseinsätze der Bundeswehr durch Bindung an das Völkerrecht
Die postulierte „Zeitenwende“ in der Sicherheitspolitik sollte nicht bloß als historische Chance verstanden werden, die vorgeschlagene Reform schnell durchs Parlament zu bekommen. Auch jenseits des konkreten Anlasses des russischen Angriffs auf die Ukraine erscheinen die materiellen verfassungsrechtlichen Grundlagen der Wehrverfassung reformbedürftig. Nach hier vertretener Auffassung sollte das Grundgesetz Auslandseinsätze der Bundeswehr an deren Völkerrechtsmäßigkeit binden. Denn wie die Initiatorinnen dieses Symposiums betonen, besteht für die deutsche Sicherheitspolitik auch eine Verantwortung für die internationale Ordnung und die Wahrung und Durchsetzung des Völkerrechts. Fighting the Backlash – The South African High Court on the Suspension of the SADC Tribunal
Today, the South African Constitutional Court may have the last word on a case concerning South Africa's suspension of the Southern African Development Community Tribunal. On 1 March 2018, the South African High Court found that this foreign policy decision violated substantive human rights. Even though it is easy to criticize the judgment for its scarce reasoning, the decision entails intriguing ideas for building a more principled foreign relations law in the South African context.
